Michael Jordan Tells Court He Felt No Fear of Nascar in Antitrust Trial

Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, stated that his competitive side and novelty within the sport motivated his push for 23XI Racing to “challenge” Nascar over perceived violations of competition laws.

Team Investment and a Competitive Drive

Jordan shared financial and corporate details of his 23XI team, revealing he invested $40 million of his personal wealth into the Cup Series operation launched with partner Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan said during testimony. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar as a whole. From my perspective, the sport it needed to be looked at from a different view.”

Central Issue: Franchise System and Contract Pressure

At issue is the expiration of a 2016 agreement where Nascar granted each team a franchise. This system mirrors other professional sports with separately owned franchises, like the NBA’s Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar demanded teams renew their charters.

Jordan testified for about sixty minutes and left the court to a media frenzy, with fans and media clamoring for a view or a photo of the global icon.

Spearheading the Fight

23XI Racing is leading the full-court press along with another racing team for Nascar to change a business model Jordan said is unlawful to keep two hands on the wheel.

At issue for Jordan and a fellow team representative, who testified before Jordan, are events from September 2024. She recounted a hectic and tense six hours where the sanctioning body informed teams they had to sign a charter agreement extension. This agreement spanned 112 pages detailing team compensation and a guaranteed spot in every race.

Choosing Litigation

Jordan explained that 23XI and Front Row Motorsports concluded their only feasible option was to refuse a signature that extensive document and take the issue to court. All other teams agreed to the terms.

Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or extension options. Nascar refused to engage, Jordan said.

The Ultimate Motivation: Winning

But in the end, the resistance against what he saw as a financially unsustainable model was driven by the familiar goal for Jordan: Winning.

“Hamlin persuaded me adding a third car boosted our odds of winning,” he said, sharing that he purchased another franchise late in 2024 for $28 million amid the legal dispute. “So I dove in.”

Heather Gibbs’ Testimony

Heather Gibbs detailed her request for permanent charters, which she said a formal letter to Nascar. She said the timing of the contract signing demand didn’t sit well.

According to her, Joe Gibbs first attempted to call and persuade Nascar against forcing signatures, but CEO Jim France refused the appeal.

“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “Whether I have 20 charters, that’s what I have. If I have 30, I have 30.”
