Trump Team Asks Supreme Court Permission to Fire Top Intellectual Property Director
The former president's administration on Monday petitioned the nation's highest court to permit the termination of the director of the American copyright authority.
This urgent appeal follows about six weeks after a federal appellate court in Washington decided that the director, Shira Perlmutter, could not be unilaterally fired.
Almost one month prior, the entire District of Columbia circuit court declined to reconsider that ruling.
This case is the most recent in a series of disputes related to presidential authority to place preferred leaders at government offices.
The Supreme Court has generally permitted such dismissals, even as court disputes continue.
However, this particular matter involves an bureau inside the Library of Congress. Perlmutter acts as the register of copyrights and also advises Congress on intellectual property matters.
The government's top lawyer, D John Sauer, stated in the legal document that, despite ties to the legislative branch, the director “wields administrative power” in regulating intellectual property rights.
Perlmutter claims she was terminated in May because the ex-leader disapproved with recommendations she provided to Congress in a report concerning artificial intelligence.
She reportedly received an email from the White House informing her that her position was “terminated starting immediately,” according to her office.
A split appellate panel ruled that Perlmutter could retain her job while the case moves forward.
“The Executive's alleged blatant meddling with the duties of a Legislative Branch officer, as she carries out statutorily approved duties to counsel the legislature, strikes us as a breach of the separation of powers,” wrote Justice Florence Pan for the appeals court.
Justice J Michelle Childs joined the ruling. Both judges were nominated to the appellate court by Democrat President Joe Biden.
In opposition, Judge Justin Walker, a former president's nominee, wrote that Perlmutter “exercises administrative authority in a variety of manners.”
Perlmutter's attorneys have contended that she is a renowned copyright specialist. She has acted as copyright director since ex- librarian of Congress Carla Hayden appointed her to the position in October 2020.
The ex-leader named assistant attorney general Todd Blanche to replace Hayden at the national library. The administration had dismissed Hayden following criticism from right-leaning groups that she was promoting a “woke” program.
