US Court Mandates Release of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without legal authority.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The situation stems from a mistaken removal to El Salvador in March, which US authorities later admitted was an error. After his return to the United States to face alien smuggling charges, he was detained in immigration detention.
In her order, the court noted that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
